TOTAL WELL CONNECT MEMBERSHIP
AFFILIATE PROGRAM TERMS AND CONDITIONS

These Affiliate Program Terms and Conditions (“Agreement”) govern participation in the Total Well Connect Membership Affiliate Program (“Affiliate Program”). By applying to or participating in the Affiliate Program, you (“Affiliate,” “you,” or “your”) agree to be legally bound by this Agreement in its entirety.
If you do not agree, do not participate.
1. Program Overview
The Total Well Connect Membership Affiliate Program allows approved affiliates to earn recurring commissions by referring new paying members to the Total Well Connect Membership (“Membership”) through an authorized affiliate tracking link.
Affiliate tracking, reporting, and payouts are administered through Tapfiliate or any successor or replacement platform selected by Total Well Connect.
2. Eligibility, Location, and Approval Authority
Participation in the Affiliate Program is available exclusively to individuals and entities physically located within the United States.
To be eligible, an Affiliate must:
Be at least 18 years of age
Be a legal resident of the United States with a bank account. Payments will only be paid in USD even if other is selected. USD is the ONLY form of payment.
Maintain an active, paid Total Well Connect Membership at all times
Provide accurate and truthful registration information
Be approved at the sole discretion of Total Well Connect
Total Well Connect retains complete, sole, and absolute discretion to approve, deny, suspend, or revoke any affiliate application or account for any reason or no reason, with or without notice.
Use of VPNs, proxies, or third-party arrangements to appear U.S.-based is strictly prohibited.
3. Commission Structure
Affiliates earn $5 USD per month for each referred individual who:
Purchases a paid Membership using the Affiliate’s unique tracking link, and
Remains an active, paid member in good standing
Commissions are strictly recurring only while the referred Membership remains active and paid.
The moment a referred member:
Cancels
Defaults
Fails payment
Pauses
Is refunded
Is charged back
Loses active status for any reason
The $5 monthly commission immediately and permanently stops.
There are no lifetime, residual, guaranteed, or vested commissions.
4. Affiliate Membership Requirement
Affiliates must maintain an active, paid Total Well Connect Membership to remain eligible for commissions.
If an Affiliate:
Cancels their membership
Allows their membership to lapse
Defaults on payment
Is removed for any reason
Then all affiliate commissions immediately cease, including commissions for:
Past referrals
Current referrals
Future referrals
Commissions do not resume retroactively under any circumstances.
5. Payment Terms, Timing, and W-9 Requirement
Affiliate commissions are calculated monthly and paid at the end of each calendar month, subject to verification and compliance with this Agreement.
No payments will be issued unless a valid IRS Form W-9 has been submitted, approved, and is on file.
Total Well Connect reserves the right to withhold payments until all tax documentation requirements are satisfied.
Payments are issued only for valid, earned commissions that are not subject to refund, chargeback, dispute, clawback, suspension, or termination.
Minimum payout thresholds, administrative holds, and processing delays may apply.
Failure to submit or maintain valid tax documentation may result in withheld or forfeited commissions.
6. Tracking, Cookies, and Attribution
Affiliate tracking is managed through Tapfiliate and relies on cookies and platform-level attribution.
Cookie duration is determined by platform settings (currently 30 days, unless modified).
Last valid affiliate click wins.
Attribution may be overridden by internal campaigns, system rules, or compliance requirements.
Total Well Connect does not guarantee tracking accuracy due to:
Cookie deletion
Ad blockers
Browser privacy settings
Cross-device activity
Platform outages
All attribution decisions are final and non-appealable.
7. Disputes and Adjustments
Affiliate commission disputes must be submitted within 14 calendar days of the disputed event.
After this period:
All commissions are deemed accurate and final
No retroactive adjustments will be made
Total Well Connect retains sole and absolute authority to resolve all disputes.
8. Refunds, Chargebacks, and Clawbacks
If a referred Membership is:
Refunded
Charged back
Disputed
Canceled
Defaulted
Any associated commissions are void.
Total Well Connect reserves the right to:
Reverse unpaid commissions
Deduct previously paid commissions from future payouts
Recover improperly paid commissions
Affiliates expressly authorize such clawbacks as a condition of participation.
9. Prohibited Activities
Affiliates may not:
Self-refer or create duplicate accounts
Misrepresent Total Well Connect or the Membership
Use spam, bots, click farms, or traffic manipulation
Bid on trademarks or impersonate the brand
Use unauthorized coupons or incentives
Sell, transfer, or share affiliate accounts
Violations result in immediate termination and forfeiture of commissions.
10. Marketing and Legal Compliance
Affiliates must:
Comply with all applicable U.S. federal and state laws
Follow FTC affiliate disclosure requirements
Avoid misleading or deceptive marketing
Total Well Connect may require removal or modification of promotional content at any time.
11. Suspension, Termination, and Program Changes
Total Well Connect may suspend or terminate:
Any affiliate
Any group of affiliates
Or the entire Affiliate Program
At any time, for any reason, including unforeseen, regulatory, operational, or business circumstances, without liability.
Termination results in:
Immediate deactivation of affiliate links
Loss of future commissions
Possible forfeiture of unpaid commissions
12. Independent Contractor Status
Affiliates participate as independent contractors, not employees.
Nothing in this Agreement creates:
An employer-employee relationship
A partnership
A joint venture
An agency relationship
Affiliates are not entitled to wages, benefits, unemployment insurance, or workers’ compensation.
13. Taxes and Reporting
Affiliates are solely responsible for all federal, state, and local taxes arising from affiliate earnings.
Total Well Connect does not withhold taxes
IRS Form 1099 will be issued where required by law
Affiliates agree to indemnify Total Well Connect for any tax liability arising from misclassification claims
14. No Guaranteed Income
Affiliate earnings are:
Not guaranteed
Not wages
Subject to change or termination at any time
Affiliates assume all financial risk.
15. Confidentiality
Affiliate dashboards, reports, commission data, and systems are confidential and may not be shared, copied, or reverse-engineered.
16. Limitation of Liability
Total Well Connect is not liable for:
Lost profits
Indirect or consequential damages
Tracking failures
Platform outages
Third-party system errors
17. Indemnification
Affiliates agree to indemnify and hold harmless Total Well Connect from any claims, damages, losses, or expenses arising from:
Affiliate conduct
Violations of this Agreement
Legal or regulatory non-compliance
18. Governing Law and Venue
This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles.
Exclusive venue lies in Travis County, Austin, Texas.
19. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or representations.
No oral modifications are valid.
20. Acceptance
Participation in the Total Well Connect Membership Affiliate Program constitutes full, knowing, and binding acceptance of these Terms and Conditions.
